By continuing to use the services provided by TimothyLunnTutoring, you agree to comply with and be bound by the following terms and conditions.

TimothyLunnTutoring cannot be held responsible for examination results or academic outcomes that do not meet a student’s expectations.

Cancellation Policy 

If you need to cancel a tutoring session, please contact TimothyLunnTutoring using one of the following methods:

Cancellations made with less than 48 hours’ notice will be charged at the full session rate. This applies regardless of the reason for cancellation, including illness or technical issues.

If a student fails to attend a scheduled session without prior notification, the full session fee will remain payable.

Tuition sessions are reserved for each student at a fixed day and time each week and will continue until the student’s final examination, unless cancelled in accordance with this agreement. The reserved weekly session may be cancelled at any time with a minimum of one week’s notice.

Where TimothyLunnTutoring is required to cancel a scheduled session, reasonable notice will be given. Cancelled sessions will be rescheduled at a mutually convenient time or refunded if rescheduling is not possible. TimothyLunnTutoring shall not be liable for any additional costs incurred by clients as a result of tutor cancellation. Where TimothyLunnTutoring is unable to deliver a scheduled tuition session due to events beyond the tutor’s reasonable control, including but not limited to illness, power failure, internet or platform outages, technical failures, severe weather, or other emergencies, TimothyLunnTutoring shall not be deemed in breach of these Terms and Conditions. In such circumstances, affected sessions will be rescheduled where reasonably possible. Where rescheduling is not possible, a refund will be offered.

TimothyLunnTutoring reserves the right to refuse to provide tuition or to decline the continuation of services at its discretion, subject to applicable law. This may include, but is not limited to, situations involving unreasonable behaviour, non-payment, repeated cancellations, or breakdown of the tutor–student or tutor-parent relationship.

This tutoring agreement may be terminated at any time by either party. Where TimothyLunnTutoring is required to end the tutoring arrangement, reasonable notice will be provided wherever possible, and referrals to alternative tutors may be offered upon request.

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, clients have the right to cancel an agreement within 14 days of entering into it, unless tuition has begun during this period. Where tuition has commenced within the 14-day cooling-off period at the client’s request, the client acknowledges that they may be required to pay for any sessions already delivered.

Where a block of lessons has been paid for and TimothyLunnTutoring terminates the tutoring agreement, a refund will be issued for any unused tuition sessions. Where a client terminates the agreement, any unused lessons will be refunded provided at least 24 hours’ notice is given before the next scheduled tuition session.

Timings 

Tuition sessions will run strictly for the agreed duration and cannot be extended beyond the scheduled end time, as this would impact other students and the tutor’s timetable.

Where a student arrives late to a scheduled session, the session will still conclude at the agreed end time and the full fee will remain payable.

Lesson times are displayed in UK time via the Calendly booking system. Students and parents are responsible for converting lesson times to their local time zone where applicable.

All fees are payable in British Pounds Sterling (GBP). Any bank transfer fees, international transaction charges, or currency conversion costs are the responsibility of the student or parent.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, regardless of the student’s location. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Payment Options 

Payment is collected via automatic card payment using the details registered to your account and processed through Stripe. Fees are charged one week in advance.

Invoices must be paid in full by the stated due date. Failure to make payment will result in tutoring services being suspended until the outstanding balance has been settled.

Billing is weekly by default. Clients who prefer monthly or termly invoicing should contact the tutor to discuss alternative arrangements.

Where payment has not cleared prior to the scheduled lesson start time, the lesson will not proceed and subsequent sessions cannot be confirmed until payment has been received.

In cases where repeated payment reminders are required, TimothyLunnTutoring reserves the right to withdraw the student’s reserved lesson slot and to refuse further tuition.

The hourly rate agreed at the time of enrolment is guaranteed for the full duration of the student’s tuition and will not be increased, even if rates for new students rise during this period. This rate guarantee applies to individual students only and does not extend to siblings.

Communication

This agreement is entered into by a parent or legal guardian, who accepts responsibility for payment, compliance with these Terms and Conditions, and the student’s conduct during tuition.

While parental support is valued and encouraged, the tutor retains full responsibility for, and control over, the format and content of tuition sessions. All parties are expected to communicate with one another respectfully at all times.

An adult guardian must be present on the same premises for the duration of the lesson. Guardians may discreetly observe a session if they wish; however, they should not actively participate in the lesson, as this may discourage students from making mistakes and can inhibit effective learning.

Tuition fees cover scheduled lesson time and homework only. Support outside of lessons, including email or message-based academic assistance, is not included unless explicitly agreed in advance.

TimothyLunnTutoring will endeavour to respond to communications within a reasonable timeframe during normal working hours. There is no expectation of immediate or out-of-hours responses.

TimothyLunnTutoring is operated by Timothy Lunn as a sole trader, based in the United Kingdom.

All complaints will be acknowledged within 48 hours, and every effort will be made to resolve the matter within 14 days.

If you remain dissatisfied following this process, you may refer the matter to The Tutors’ Association for further consideration.

Lessons

All tuition sessions will be delivered via Google Meet, and all work will be set and shared digitally.

Each student is responsible for ensuring they are fully prepared for each session, including having access to the correct link, a suitable electronic device, and any required resources.

The student agrees to participate fully in each session, including the use of a microphone and webcam, unless otherwise agreed in advance. The student acknowledges that tasks, exercises, and homework form an integral part of the tutoring process and agrees to complete such work as set. The student agrees to provide the tutor with an outline of the topics covered by their school, in order to enable lessons to be personalised to meet the student’s individual learning needs

Students will be set optional weekly homework. To ensure timely and effective feedback, all homework must be submitted by 10:00 a.m. on Sunday of the week in which it is set. Work submitted after this deadline will not be eligible for feedback.

TimothyLunnTutoring does not complete homework assignments on behalf of students for their schoolteachers, nor does TimothyLunnTutoring complete coursework that contributes to final grades.

All lesson materials, resources, worksheets, and teaching content provided by TimothyLunnTutoring remain the intellectual property of the tutor unless otherwise stated. Materials are provided for the student’s personal educational use only and may not be copied, distributed, shared, sold, or reused for commercial or teaching purposes without prior written consent.

Tuition may involve the use of third-party platforms, websites, or resources, including examination board materials and online tools. TimothyLunnTutoring is not responsible for the content, availability, or functionality of third-party services and accepts no liability for any loss arising from their use.

Code of Conduct 

TimothyLunnTutoring agrees to plan and deliver lessons, and to supply digital resources, designed to maximise each student’s potential to achieve their target grade. TimothyLunnTutoring agrees to treat students’ names and images as confidential. Where lesson materials or sessions are used for marketing or promotional purposes, any names and identifying images will be anonymised or obscured unless prior consent has been obtained.

Students are expected to be appropriately dressed for online tuition. Comfortable, informal clothing is acceptable, provided it is suitable for a professional learning environment.

Students are permitted to record or take screenshots of online tuition sessions for their own personal study purposes only. Any recordings or screenshots must not be shared with, shown to, or made available to any third party, nor uploaded to any online platform. An exception is permitted where a recording is shared with a responsible adult if the student has concerns regarding the quality or content of a lesson.

Students may not be joined in lessons—whether one-to-one or group, online or in person—by friends or any other individuals without prior agreement and appropriate payment. Any additional person wishing to participate in a lesson must be registered as a student and will be charged at the applicable group tuition rate.

While every effort is made to provide high-quality tuition, no guarantee can be given in respect of specific examination results or grades. Tuition is intended to support learning, and academic outcomes depend on a range of factors, including the student’s own effort and engagement. TimothyLunnTutoring is not affiliated with any school, examination board, or awarding body. The tutor has no influence over examination content, marking, moderation, or grading decisions.

To the fullest extent permitted by law, the tutor’s liability for any claim arising out of or in connection with the provision of tutoring services shall be limited to the total fees paid for the specific lesson or lessons giving rise to the claim. The tutor shall not be liable for any indirect, consequential, or incidental losses.

Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

These Terms and Conditions are governed by the laws of England and Wales, and any disputes arising under or in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms and Conditions affects your statutory rights as a consumer under UK law. If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, such provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.

These Terms and Conditions may be updated from time to time. Any significant changes will be communicated to existing clients, and the most recent version will be made available upon request. Continued use of tutoring services following any amendments constitutes acceptance of the updated Terms and Conditions.

TimothyLunnTutoring reserves the right to make reasonable changes to the delivery of tutoring services where necessary. This may include changes to online platforms, systems, lesson formats, or administrative processes. Any changes will not materially disadvantage students and, where appropriate, reasonable notice will be given.

These Terms and Conditions constitute the entire agreement between the parties in relation to the provision of tutoring services and supersede any prior discussions, correspondence, or agreements, whether written or oral. No variation to these Terms and Conditions shall be effective unless agreed in writing.

Safeguarding 

TimothyLunnTutoring is committed to safeguarding and promoting the welfare of children and young people. All tuition is delivered in a professional manner, in line with best practice for online learning.

Students are expected to attend sessions in a condition that allows them to participate effectively and safely. Where a student appears unwell, distressed, or otherwise unable to engage productively, TimothyLunnTutoring reserves the right to pause or end the session early in the interests of the student’s wellbeing. In such cases, the session fee will remain payable unless otherwise agreed.

Any safeguarding concerns arising during tuition will be taken seriously and may be reported to parents or guardians and, where appropriate, to relevant external agencies.

TimothyLunnTutoring reserves the right to terminate tuition immediately, without notice, where safeguarding concerns arise or where behaviour places the student, tutor, or others at risk.

Data Protection & Privacy 

TimothyLunnTutoring is committed to protecting the privacy and personal data of students and their parents or guardians in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Personal data collected may include names, contact details, billing information, lesson notes, academic information, and records of communication. This data is collected solely for the purposes of delivering tutoring services, managing bookings and payments, communicating with clients, and maintaining appropriate records.

Personal data is stored securely and accessed only where necessary. Data may be shared with trusted third-party service providers (including Stripe, Calendly, Google, and email or cloud storage providers) strictly for the purposes of delivering tutoring services and administering payments.

Personal data will not be shared with third parties for marketing purposes and will not be retained for longer than is necessary.

Clients have the right to request access to, correction of, or deletion of their personal data, and the right to lodge a complaint with the Information Commissioner’s Office (ICO). Any data protection enquiries should be directed to:

Tuition is delivered in accordance with the Equality Act 2010, and no student will be treated less favourably on the basis of any protected characteristic, including (but not limited to) age, disability, gender reassignment, race, religion or belief, sex, or sexual orientation.

TimothyLunnTutoring recognises that students learn in different ways and may require different approaches in order to engage effectively. Where a student has additional learning needs, disabilities, or specific educational requirements, reasonable adjustments will be considered wherever practicable in order to support learning and participation. This may include adaptations to lesson structure, pace, or teaching methods.

Parents or guardians are encouraged to disclose any relevant learning needs, diagnoses, or support strategies at the outset of tuition to enable lessons to be planned appropriately. While every effort will be made to accommodate individual needs, TimothyLunnTutoring cannot guarantee that all requests for adjustments can be met, particularly where such adjustments would require specialist provision beyond the tutor’s expertise or resources.

TimothyLunnTutoring reserves the right to decline or discontinue tuition where, despite reasonable adjustments, the tutor reasonably believes that the service cannot meet the student’s needs effectively or safely. In such cases, this decision will be made sensitively and in good faith, and referrals to alternative provision may be offered where appropriate.
